Qualifications:Minimum of 20 year(s) of experience in brand development, management, protection, and administration. Specific experience with trademark portfolio management as well as assisting and supporting attorneys and clients in various aspects of trademark prosecution and administrative proceedings before the USPTO is essential. Must be able to perform complex trademark searches, including design searches on various USPTO databases, including the Trademark Search system and the Trademark Trial and Appeal Board Inquiry System. - Experience required with Windows, MS Word, MS Excel
- United States Patent and Trademark Office Systems, including the Trademark Electronic Application System (TEAS) and General Legal Request or Take-down procedures for media and retail web platforms
Duties:Develop intellectual property (primarily trademark) guidance, SOPs, and other tools for use by National Park Service staff. Collaborate with NPS brand managers in brand development, management, protection, and administration. Support agency attorneys on all aspects of trademark establishment, management, and protecting. - Develop intellectual property policies, guidance documents, and associated training and job aids. Contribute to a variety of online resources to guide NPS brand and IP decision making, such as standard operating procedures, decision trees, templates and online content. These resources will inform management, protection, enforcement, prosecution, administration, and licensing of the NPS brand and will be developed and reviewed in coordination with the NPS Brand Team and DOI Solicitors Office (SOL). Support implementation of policies directed at headquarters staff. For example, work with communications staff to create webpages, update standard language in nps.gov disclaimers, provide language for use by other programs on their webpages, and develop and deliver training. 60%
- Collaborate with SOL on tracking and assisting with trademark monitoring and enforcement, including drafting cease and desist letters, and assisting SOL with all aspects of trademark litigation. Conduct ongoing research involving NPS protected marks, monitor major online retailers, and manage registration actions, where possible. Assist SOL on all aspects of trademark portfolio management, including conducting trademark searches, client usage, trademark application filings, prosecution matters, and trademark policing and enforcement (i.e., pre- and post-registration challenges at the USPTO and affirmative and defensive actions in federal district court). 20%
- Support finalization and/or implementation of intellectual property agreements and templates, specifically including agreements between the NPS and the National Park Foundation. 20%
